1.        By choosing to continue to use this service (“Südtirol Info”), the user (the “User”) agrees to comply with (and be bound by) the following Terms and Conditions of Use (“Terms and Conditions”), which together with the other terms and conditions, notices and disclosures contained in Südtirol Info, govern the relationship between IDM Sudtirol – Alto Adige (“IDM”) and the User in the use of the website and its complementary apps.

2.        Südtirol Info is not intended for use by minors. By continuing to use Südtirol Info, the User warrants and represents that they are at least 18 years of age.

3.        IDM reserves the right to amend these Terms and Conditions at any time by amending this document. The User is obliged to check these pages on a regular basis, acknowledging on each occasion any amendments, which are binding.

The new Terms and Conditions will bear the date of the last update.

1.        The term “Südtirol Info” refers to the platform created by IDM Sudtirol – Alto Adige, with registered office at Piazza della Parrocchia 11, 39100, Bolzano, Italy (already defined, IDM). Südtirol Info consists of the website which can be consulted at the URL https://www.suedtirol.info and its complementary pages and apps, including, as a non-limiting example, the South Tyrol/Südtirol Guide APP, (“APP”) that allows users to use all the website functions in addition to other advantages based on the geolocation of the devices. The APP is available on Google Play and the App Store and can be used via smartphone.

2.        The term “User” is reserved for visitors to Südtirol Info regardless of whether they have made a booking or have registered in the personal area.

3.        The term “Service(s)” refers to what IDM offers to its Users. In particular, as a non-limiting example, the Services consist in the presentation of accommodation providers (“Accommodation Provider(s)”) for possible bookings by Users, as well as in the offer of information, news and opportunities related to tourism in Alto Adige-South Tyrol with the relative description of experiences, excursions, visits and every other tourist offer available in the aforementioned area. Users can also decide to receive periodic newsletters related to the Services in order to stay updated on IDM’s news and initiatives.

4.        The term “Accommodation Provider(s)” refers to hotels, residential facilities, holiday farms, hostels, campsites, bed and breakfasts and other hospitality facilities that advertise their rooms/accommodations in Südtirol Info for possible bookings by Users.

5.        The term “Account” refers to the set of identification data relating to the User who decides to register with Südtirol Info as described in Article 4.

6.        The term “Favourites” refers to the pages of Südtirol Info  and the Services that the User decides to save inasmuch as relevant for future use and access; therefore, they will be referable to the specific section of the Account. By saving, the User will find any saved content in the Favourites at any time The User may decide to delete the Favourites that are no longer of interest.

1.        The content of Südtirol Info  is prepared with the utmost diligence; however, IDM does not warrant that the data is always correct and up-to-date, as it is externally sourced. In particular, IDM disclaims any liability for inaccuracies relating to the information and/or descriptions of Accommodation Providers as well as to other Services of any kind of third parties advertised through Südtirol Info .

2.        In particular, IDM is not involved in the relationship between the User and the Accommodation Provider. Any transaction or obligation arising from a contract established through Südtirol Info  will bind the User and the Accommodation Provider independently, according to the terms and conditions presented by the Accommodation Provider. This principle also applies to third parties that are not Accommodation Providers: IDM intervenes, in fact, as a mere instrument of interaction between the parties. The Accommodation Providers are solely liable for fulfilling the booking requests received through Südtirol Info  following their communication of availability.

3.        IDM is in no way and at no time liable for the accuracy, completeness and correctness of the information provided by the Accommodation Providers, including the rates and availability displayed in Südtirol Info .

4.        IDM does not provide any warranty as to the capacity, competence and quality of the services published, in particular, those that may be offered by an Accommodation Provider that comes into contact with the User.

5.        IDM has no liability for the deletion or failure to preserve content stored in or transmitted from Südtirol Info .

6.        IDM may not be held liable for any temporary malfunctions of Südtirol Info resulting from causes outside IDM’s control.

7.        IDM will have no liability for any damage or loss, financial or otherwise, resulting from the use or inability to use Südtirol Info or the Services.

8.        IDM may not be liable for any geographical limitations: access to the contents of Südtirol Info may not be permitted in certain countries. The User accesses at their own risk and assumes liability for compliance with the laws of their jurisdiction.

9.        IDM will not be liable for any loss or damage caused by viruses or other harmful material/malware or other computer attacks that may infect the Users’ computer equipment, computer programs, data or other proprietary material as a result of using Südtirol Info or downloading any material posted thereon, or on any website linked thereto.

10.    Certain services provided by mobile applications (APPs) connected to Südtirol Info are linked to the geolocation function. The localisation of the device depends on the data service of the User’s telephone provider and does not depend in any way on the APP.

1.        The User may also register themselves in Südtirol Info to access their favourites (“Favourites”) and use Südtirol Info ’s functions. Registering an account (“Account”) is free of charge, it is permitted only to persons of legal age and allows the User to customise their experience in Südtirol Info.

2.        The registered User is responsible for the Account and their access credentials, which may consist of the e-mail address entered at the time of registration to which a verification code will be sent for authentication at each access, or of the other methods provided for access to the Account (e.g. through Facebook, Google profiles).

3.        The User accepts responsibility for all activities associated with the Account and the relative access.

4.        Via the Account, the User can manage their Favourites, their data and the relative consents.

5.        IDM reserves the right to delete an Account if, in its sole discretion, it detects irregularities or usage violations.

6.        The User may request the deletion of the Account by using the specific command available in the personal area. Deletion of the Account entails the definitive deletion of all data associated therewith.

1.        The contents of Südtirol Info relating to the Services are provided by third parties: IDM merely publishes them. Occasionally, Südtirol Info may also include links to other websites. These links do not imply that IDM endorses the indicated website(s). Likewise, IDM has no liability for the content of the referenced website.

2.        It is not allowed to use Südtirol Info to copy, store, retain, transmit, send, initiate, publish or distribute any material that consists of (or is linked to) any form of spyware, virus, Trojan horse, worm, keystroke logger, rootkit or other hazardous or technologically harmful material. It is not allowed to attack Südtirol Info by means of a full domain compromise, denial-of- service or distributed denial-of-service attack.

3.        Generating and/or disseminating unsolicited commercial e-mails (spam) is expressly prohibited.

4.        Users are not allowed to carry out systematic or automated data collection activities on or in connection with Südtirol Info.

5.        It is expressly forbidden to knowingly provide false information with regard to personal data and/or data concerning Users for which they are responsible. 

1.        The rates and cancellation conditions published in Südtirol Info are set directly by the Accommodation Providers; therefore, they are not linked to a decision of IDM, which is in no way involved. The rates may contain restrictions on special conditions, e.g. regarding cancellations, no-shows or refunds.

2.        Before making a booking, the User must carefully check, directly on the page of the desired Accommodation Provider, the economic and payment conditions directly with the Accommodation Provider.

3.        Payments take place outside the platform and are not a function of Südtirol Info, which refers to a third-party merchant link; therefore, IDM has no control over the outcome of any booking.

4.        IDM has no liability for the failure of bookings due to invoicing and payment problems.

1.        In addition to the Services already envisaged in these Terms and Conditions, the APP allows the User experience to be personalised, as a non-limiting example, with the following functions:

-          tip of the day: the APP recommends 10 activities and points of interest daily according to the season of the year;

-          weather: the APP offers the weather forecasts for Alto Adige-South Tyrol (provinces of Bolzano, Bressanone, Brunico, Merano, Silandro, Vipiteno) for the current day and, from 11.00 am on the day of viewing, also those for the following day. The User also has the option of activating the weather push notification, which is sent daily at 8 am;

-          beacon scan: the User who wish to receive more detailed information on local attractions during their stay in Alto Adige-South Tyrol can use this function. The APP alerts the User as soon as they are in the vicinity of a POI (Point of Interest), understood as a place of interest related to the tourism in the area, including, as a non-limiting example, churches, monuments, museums, experiences, excursions, tours, restaurants, bars, events and any other tourist proposal available in the area, offering the relevant information.

2.        IDM is free to add, remove and supplement the functions of the APP without prior notice or communication.

3.        Geolocation makes it possible to make use of Südtirol Info Services and receive information and suggestions based on the User’s geographical position, e.g., restaurants in the vicinity of the position, Facilities, tourist proposals from the APP.

1.        All information provided by the Accommodation Providers and third party suppliers and published in Südtirol Info remains their property. The contents of IDM, on the other hand, remain its exclusive property.

2.        IDM is the exclusive owner of Südtirol Info design and layout and of the logos. The use of any part of the material available in Südtirol Info for commercial purposes is not allowed without obtaining express authorisation from IDM.

1.        The use of Südtirol Info is governed by Italian law. All disputes arising from the use of Südtirol Info will fall under the exclusive jurisdiction of the Court of Bolzano. This is without prejudice to the rights of consumers to seise the court of their place of residence or domicile.

2.        These Terms and Conditions are written in Italian. In the event of a conflict between translations into different languages, the Italian version will prevail.
